Kosovo Leaders in International Court – Finally

The first trial opened on Sep.15th 2021 at a special court (The Kosovo Specialist Chambers- KSC) dealing with crimes during the 1998-1999 Kosovo conflict.  The first case is against Salih Mustafa, 50, a former pro-independence commander who faces charges of murder, accused of running a prison unit. Prosecutors said victims were fellow Kosovo Albanians who disagreed politically with Kosovo Liberation Army fighters. The KSC has indicted eight suspects, all of whom are in custody at a detention unit in the Dutch seaside town of Scheveningen. 

The Kosovo tribunal’s highest-profile suspect is former Kosovo President Hashim Thaci, who resigned in 2020 and turned himself last year to face charges of war crimes and crimes against humanity.  One could note that less than a year ago, Kosovo’s Prime Minister Ramush Haradinaj resigned after he was summoned by the same court on suspicion of war crimes.

Thaçi is from the region of Drenica in Kosovo, which is where the Kosovo Liberation Army (KLA) originated. He studied philosophy in Prishtina before moving to Switzerland, where he joined the KLA  in 1993. He rose through the ranks of the KLA to become leader of the most powerful faction by 1999, during the Rambouillet negotiations. He then joined the interim Kosovo administration after the war.

Thaçi became leader of the Democratic Party of Kosovo (PDK), which won the largest share of the vote in the 2007 Kosovo elections. In 2008, Thaçi declared the independence of Kosovo and became its first prime minister. In 2016 he was elected President of Kosovo. Thaçi has pursued a pro-American policy while in office. There have been controversies regarding Thaçi’s role in the KLA and allegations about him being involved in organized crime. In 2020, the Kosovo Specialist Chambers and Specialist Prosecutor’s Office filed a ten-count Indictment, charging Hashim Thaçi and others for crimes against humanity and war crimes.Thaci, a U.S.-backed national hero, embarked on his political career after leading the KLA’s battle against forces under Milosevic. He has been the dominant political figure in the country since its independence 13 years ago. Thaçi subsequently resigned from his position as president, in his words, in order to “protect the integrity of the presidency of Kosovo”.

Links between drug trafficking and the supply of arms to the KLA Kosovo Liberation Army (KLA aka UÇK) were established mid-90s during war in Bosnia. In West KLA was described as terrorist organization but when US selected them as their ally it transformed organization officially to “freedom” fighters. After bombing Serbia 1999 KLA leaders again changed their crime clans officially to political parties.  In my earlier article Quadruple Helix – Capturing Kosovo  (in 2008) I described how (Kosovo) Albanian organized crime organizations gained remarkable role in Europe. 

 

Thaçi and other members of his inner circle were “commonly identified, and cited in secret intelligence reports” . For example the German secret state agency, the Bundesnachrichtendienst (BND), describes Thaçi’s Drenica group “as the most dangerous of the KLA’s ‘criminal bosses’.

In April 2008 Madam Carla Del Ponte, the former Chief Prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY), published a book “La caccia – Io e i criminali di guerra”. In the book, almost ten years after the end of the war in Kosovo, there appeared revelations of trafficking in human organs taken from Serb prisoners, reportedly carried out by leading commanders of the Kosovo Liberation Army (KLA). The report, “Inhuman treatment of people and illicit trafficking in human organs in Kosovo” , for Council of Europe Parliamentary Assembly (PACE), prepared by Swiss prosecutor-turned-politician Dick Marty, expands on allegations made by Mrs. Del Ponte.

The PACE report claims that civilians – Serbian and non-KLA-supporting Kosovan Albanians detained by the KLA in the 1999 hostilities – were shot in northern Albania and their kidneys extracted and sold on the black market. It names Hashim Thaçi, the former leader of the KLA and Kosovo’s prime minister, as the boss of a “mafia-like” group engaged in criminal activity – including heroin trading – since before the 1999 war.

I agree with those who claim that it is clear that Kosovo’s secession from Serbia, as well as its hasty recognition as an independent state, was a mistake. While I was working in Kosovo after bombings as EU expert for local administration it was clear how Kosovo Albanian ”freedom fighters” started to transform themselves to political leaders of this then international protectorate. International community – via UN/UNMIK, NATO/KFOR, EU/TAFKO/EAR and affiliates – which were administrating Kosovo, was well aware of the direct links between organized crime clans and political leaders.

Croatia’s Nazi Orientation Still Continues

A piece of news in BalkanInsight produced a déja vu impression on me. A quote:

A memorial plaque honouring World War II concentration camp victims who died on the Croatian island of Pag has been vandalised again…The attack came just weeks after the plaque was replaced at a commemoration in late June for the victims of the WWII concentration camp complex which included Slana and Metajna on Pag and Jadovno on the nearby Croatian mainland…It was run by the Ustasha authorities who ruled part of the former Yugoslavia during WWII in alliance with Mussolini’s Italy and Hitler’s Nazi Germany. The plaque was installed by Coordination of Jewish Municipalities, the Jadovno 1941 Association, the League of Anti- Fascist Veterans and the Serb National Council in Croatia.

Croatian Nazi Camp Slano on the island of Pag was established for Serbian men and Metajna for Serbian women and children. According to Italian documents and survivors’ testimonies a very large number of Serbian people have been murdered and thrown into the sea. According to the research conducted so far on the complex of Ustasha camps “Jadovno – Gospić 1941”, which also include the island of Pag, no fewer than 40,123 victims were murdered, 38,010 Serbs, 1999 Jews and the rest were ideological opponents of the Independent State of Croatia.

OK – this is only one demolized memorial, similar hooliganism hapens everywhere? Unfortunatelly however in my opinion alarming is that this last event is not an isolated act. I would compare it to the funeral given to Dinko Sakic on Summer 2008. As Sakic was a head of a WWII Jasenovac concentration camp in Zagreb, this ceremony insulted the memory of those killed in the camp run by Croatia’s Nazi-allied Ustasha regime. The Jasenovac commander and murderer was dressed in an Ustasha uniform, the priest who served at the funeral said that Sakic was a model for all Croats. Memorial Masses for WWII Croatian Mass Murderer Ante Pavelić – the original Butcher of the Balkans – in Zagreb and Split was one act describing very alarming trend to (over)emphasizing Croatia’s Nazi past. Pavelić as the Fascist Head of state of the Nazi puppet government of the “Independent State of Croatia” (NDH) bears direct responsibility for the mass murder of hundreds of thousands of Serbs, tens of thousands of Jews, and numerous Roma. The German Nazis and the Italian Fascist regimes created a puppet State run by the local fascist movement, the Ustashe, headed by Pavelic. He died in Franco’s Spain in 1959 having fled Croatia through the Vatican “rat lines” at the end of the war. To say it politely the ceremonies might indicate that residents in Croatia are still more interested in establishing their national identity than in looking towards Europe. Unfortunately from my point of view the question is more serious.

While Ante Pavelic is being officially rehabilitated in Croatia also streets and public buildings are being named after the architects of the Holocaust.. In addition it should be no surprise that for years the best seller in Croatia has been new edition of “Mein Kampf”- faithful reproduction of the original text by that great European leader, benefactor of Croatian nationalism and leader of the Third Reich, Adolf Hitler. The other bestsellers have been the anti-Semitic classic, “The Protocols of the Elders of Zion” and memories of Pavelic. Proving the existence of a ready audience for fascist thought in Croatia, Mein Kampf was published and sold in the year of 1999 – in the number more than 600 copies in hardback within days at the remarkable price of 500 kuna (75 dollars each) – roughly equivalent to a week’s average salary there.

Public monuments honoring Ustashe regime while numerous monuments erected in honour of the Partisans as well those erected in honour of civilian victims of war have been damaged or destroyed throughout the country. A square in the central part of Zagreb had been named the “Square of the victims of fascism” because during World War II, over sixteen thousand people had been deported via the square to concentration camps. In the early 1990s, this square was renamed to “Square of great Croats”. This decision was later reverted.

Croatia has no laws against historical revisionism and holocaust denial, nor does it regard denazification as a major priority. Unlike Germany and Austria, Croatia places no restrictions on the exhibition of Nazi and Ustaše symbols. In 2003, an attempt was made to amend the Croatian penal code by adding articles prohibiting the public display of Nazi symbols, the propagation of Nazi ideology, historical revisionism and holocaust denial, but this attempt was prevented by the Croatian constitutional court.

The late Croatian pro-Ustashe Nazi and Hitler-loving, Holocaust-denying antisemitic president, Franjo Tudjman, wrote in his 1988 Croatian version of Hitler’s Mein Kampf, entitled: “Wastelands of Historical Truth” the following:

Genocidal violence is a natural phenomenon in harmony with the societal and mythologically Divine nature. Genocide is not only permitted it is also recommended, even commanded by the Word of the Almighty, whenever it is useful for the survival or the restoration of the earthly kingdom of the chosen nation, or for the preservation and spreading of its one and only correct faith”.

Also in Croatia, August 4 is celebrated as a Victory Day and state authorities as well private citizens are celebrating the military operation carried out by forces from Croatia and Bosnia and Herzegovina to retake Krajina with operation ”Storm”, which might be the biggest ethnic cleansing act during Balkan Wars. Alice Mahon the Labour MP visited former Serb villages in the Krajina in 1999 and said: “I can only conclude that the Croatian government is aiming for an ethnically pure state. Serbia and the former Yugoslavia, in an exact reprise of the fascist 1940s, have been systematically attacked and dismembered by Germany and Austria since the 1980s. Germany joined the Vatican in illegally recognising Croatia in 1991 which led to that State effectively declaring war on Yugoslavia and on Serbs in Croatia. In this the Croats had the full support of Germany and the Vatican – whose funds, liberally deployed among American PR firms helped to spread pro-Croatia propaganda. Todayrock concerts with neo-nazi symbols etc are indicating wide popular acceptance to display racism, anti-Semitism, anti-Serbian acts and xenophobia in Croatia. Neo-Nazism has still good cooperation with church and e.g Wiesenthal Center has called for immediate dismissal of Director of Croatian Episcopal Archives who denies holocaust crimes at Jasenovac. What’s striking in Croatia that Church and far right neo-Nazi political groups have succeeded in engaging large crowds of fairly young people, most of whom were born at least forty years after the end of the Second World War. They come out dressed in uniforms with flags and crests of the quisling state which claimed at least half a million lives in less than five years of it’s existence. Constituent elements of the Croatian extreme right are an emphasis on the Ustasha movement during the Second World War, the creation of a strong state with an authoritarian character, territorial expansion of Croatia to its ethnic borders, especially vis-à-vis the Serbs, and a messianic mission of the Croatian nation as a bulwark of catholic Christianity.Radicalization of the public sphere is most readily visible among the younger generation, particularly in the context of football hooliganism. This happening in a country now in EU unfortunately something about todays EU itself where far-right views, neo-Nazism and xenophobia have been gaining ground during last decade. One should not forget old war crimes and especially they should not be honoured in the way like now in Croatia.

“The gigantic campaign to brainwash America by our media against the Serbian people is just incredible, with its daily dose of one-sided information and outright lies…What is today’s reality? The murderers of Jews, Serbs and Gypsies are back (in Croatia) from the US, Canada, Argentina where they fled after World War II. The Serbs fought the Nazis, and paid a terrible price for standing at the side of the allies against Hitler. Humanity owes them a debt of gratitude.” And how have the Serbs been repaid? What was their reward for their loyalty? Seventy-eight days of unmerciful US-led NATO bombing and continued vilification by the US media. In my previous articles I have portrayed Kosovo with quite dark colours. I have summarized Kosovo

as Serbian province, occupied and now international protectorate administrated by UN Kosovo mission; as quasi-independent pseudo-state has good change to become next “failed” or “captured” state; today’s Kosovo is already safe-heaven for war criminals, drug traffickers, international money laundry and radical Wahhabists – unfortunately all are also allies of western powers”.

This description can naturally be seen as individual biased view without any connection to reality. However the process which began before Xmas may lead similar outcome in western mainstream media too. Western intelligence agencies warned that Hashim Thaci ran an organised crime network in the late 1990s, they knew the KLA were criminals running the drug, slave, and weapons rackets throughout Europe, they knew the KLA was supported by Osama bin Laden (with whom Thaci met personally in Tirana in 1998 to plan the jihad in Kosovo. Despite this Western political leaders backed his Kosovo Liberation Army and its members were transformed as “freedom fighters”.

The case related to organ trafficking is now in Pristina court, according Swiss sources PM Thaçi has been prohibited from entering Switzerland “for a certain period of time”, investigations are called for allegations that sums originating from organ trafficking in Kosovo and Albania had been deposited in Swiss bank accounts. Swiss Foreign Minister Micheline Calmy-Rey has reportedly decided not to receive an award given by the Kosovo Embassy and members of the Kosovo diaspora, for her contribution to the recognition of Kosovo’s independence. The award ceremony was planned to be held on 21. December, 2010 for her contribution to the recognition of Kosovo’s independence. (Source: Euractiv )

The PACE report claims that civilians – Serbian and non-KLA-supporting Kosovan Albanians detained by the KLA in the 1999 hostilities – were shot in northern Albania and their kidneys extracted and sold on the black market. A Council of Europe report into organ trafficking in Kosovo linked the Medicus case to a wider criminal network in the Kosovo Liberation Army (KLA), which began trading in organs in 1999. A faction within the rebel guerilla army loyal to Thaci has been accused of overseeing a racket involving Serb captives. A “handful” were said, in the report, to have been shot in the head, then had their kidneys extracted. It is believed the kidneys were flown to Istanbul in ischemia bags. Thaci has strongly denied the claims. I also touched on a matter in my article New Cannibalism in Europe too? a couple of years ago.

In November 2008 police raided the property of Medicus clinic in a deprived suburb near the Kosovan capital Pristina. Patients from Canada, Germany, Poland and Israel had received organ transplants at the clinic. Victims were promised up to $20,000, while recipients were required to pay between €80,000 and €100,000 euros. But despite promises of payment the donors had left empty-handed; up to 30 victims lost their kidneys in the clinic in just eight months in 2008. The key player of is Dr. Yusuf Ercin Sonmez from Medicus clinic has been a key player in the unscrupulous organ market for more than 10 years.

A Washington-based intelligence source said the kidneys were sold to Dr. Sonmez, a 53-year-old medic. It was then that the Turkish doctor was said to have struck up a relationship with Kosovan Albanians, who, investigators believe, are implicated in the Medicus clinic case which unfolded in the confirmation hearing case on December in Pristina district court. However the present case is limited to Medicus clinic and its links to a wider network of Albanian organised criminals and events a decade ago will hopefully take place in wider trial. EU’s EULEX-operation in Kosovo will from its side examine allegations that the country’s prime minister is the head of a “mafia-like” criminal network linked to organ trafficking. if there is sufficient evidence against Thaçi or the other senior government figures implicated in the report, they could face prosecution even though most crimes are alleged to have taken place in Albanian territory. Whitewashing Organized Crime

War crimes related to organ scandal are only minor by-plot in context of organized crime in Kosovo during last decade. KLA’s transformation from OC-/terrorist group to freedom fighters was an amazing media victory which guaranteed the occupation and later capturing of Kosovo.

Neil Clark in his column Kosovo and the myth of liberal intervention – in the Guardian describes very well this hoax:

It was the KLA’s campaign of violence against Yugoslav state officials, Serbian and Kosovan civilians in 1998, which led to an escalation of the conflict with the government in Belgrade, with atrocities committed on both sides. The report is a damning indictment not only of the KLA but also of western policy. And it also gives lie to the fiction that Nato’s war with Yugoslavia was, in Tony Blair’s words, “a battle between good and evil; between civilisation and barbarity; between democracy and dictatorship”.

On 1999 the Western media was full of stories of mass graves and brutal rapes. U.S. officials claimed that from 100,000 up to 500,000 Albanians had been massacred. In 78 days the Pentagon dropped 35,000 cluster bombs, used thousands of rounds of radioactive depleted-uranium rounds, along with bunker busters and cruise missiles. Expecting to find bodies everywhere, forensic teams from 17 NATO countries organized by the Hague Tribunal on War Crimes searched occupied Kosovo all summer of 1999 but found a total of only 2,108 bodies, of all nationalities. Some had been killed by NATO bombing and some in the war between the UCK and the Serbian police and military.

Number game as cause of Nato’s attack on SerbiaAccording the Kosovo “Book of the Dead”, the equivalent of the Bosnia “Book of the Dead” by London based Bosnian Institute which finally counted the slain, has since the Kosovo war been able to establish a total about 10,000 dead or “permanently missing” (i.e. dead), of which just under 5000 are Albanians, and the rest Serbian, other minorities, or ethnicity not known. So as Albanians made up around 50% off the dead despite making up 85% of the population, they suffered proportionately much less in terms of deaths than any other group. I would draw following time axis about some core events with this campaign:

  • As side result U.S. created Bondsteel, one of the biggest U.S. military base in center of Europe – completely outside European/international jurisdiction – to serve also as secret torture/detention/investigation center of CIA.

In the bottom line – so far at least temporary – U.S. State Department and their British lapdogs were responsible for orchestrating or facilitating events mentioned above. For background information I recommend a video “General Lewis Mackenzie: We Bombed The Wrong Side”, anyway the headline of video is not so far from my point of view.

OC-connection well known

Thaçi and other members of his inner circle, Marty avers, were “commonly identified, and cited in secret intelligence reports,” published by the German secret state agency, the Bundesnachrichtendienst or BND “as the most dangerous of the KLA’s ‘criminal bosses’.” Trading on American protection to consolidate political power, thus maintaining control over key narcotics smuggling corridors, the special rapporteur writes that “having succeeded in eliminating, or intimidating into silence, the majority of the potential and actual witnesses against them (both enemies and erstwhile allies), using violence, threats, blackmail, and protection rackets,” Thaçi’s Drenica Group have “exploit[ed] their position in order to accrue personal wealth totally out of proportion with their declared activities.” Indeed, multiple reports prepared by the U.S. DEA, FBI, the BND, Italy’s SISMI, Britain’s MI6 and the Greek EYP intelligence service have stated that Drenica Group members “are consistently named as ‘key players’ in intelligence reports on Kosovo’s mafia-like structures of organised crime.”

Reliable and highly informed sources at the Institute for European Policy based in Germany, in a 2007 report commissioned for the German Armed Forces, indicated that the three leading Kosovo politicians, Ramush Haradinaj, Hashim Thaci and Xhavit Haliti, are “persons protected by the international community although they are deeply involved in all of these affairs.”Already in 2000, according to Interpol Kosovo criminals, illicit profits of 2 billion euros were laundered through more than 200 banks. The current data show much higher earnings, and this without considering the investments in the building sector, the purchase of shares and other activities. In relation to the drugs issue, according to the Italian journalist Roberto Saviano, in an interview in 2009, the Albanian mafia in Kosovo chiefs “dream” about turning the province into “a European Colombia.”

In order to achieve this, they wish to genetically engineer a type of coca plant that would grow in Kosovo’s climate. In this way, the Albanian mafia would have a monopoly over the cocaine trade. They need 20 years to achieve this,” he said, and added that “then, Kosovo will without a doubt become the new Colombia.”

International community unwilling to rock of the boat

“Two years ago a joke was being circulated on the Runet that a heroin producer has recognized its distributor’s independence. It was about Afghanistan, which was to the first to recognize the independence of the Serbian province of Kosovo which had illegally separated from Yugoslavia.” (GRTV)

International community has worked over ten years with capacity building of Kosovo administration; EU launched few years ago its huge EULEX operation for rule and law in protectorate. Still it was needed outside institutions to bring both individual case – organ trafficking/war crime – and a system error – OC/political link – to public knowledge. Why so?

An other report gives one answer. Extract from recent the Council of Europe Parliamentary Assembly (PACE) Rapporteur Jean-Charles Gardetto’s report entitled The protection of witnesses as a cornerstone for justice and reconciliation in the Balkans (The document should be adopted by the Council of Europe Parliamentary Assembly (PACE) on coming January 26.)

Moreover, when a witness does come forward, there is a real threat of retaliation. This may not necessarily put them in direct danger, losing their job for example, but there are also examples of key witnesses being murdered. The trial of Ramush Haradinaj, the former leader of the Kosovo Liberation Army, well illustrates this. Mr. Haradinaj was indicted by the ICTY for crimes committed during the war in Kosovo but was subsequently acquitted. In its judgment, the Tribunal highlighted the difficulties that it had had in obtaining evidence from the 100 prosecution witnesses. Thirty-four of them were granted protection measures and 18 had to be issued with summonses. A number of witnesses who were going to give evidence at the trial were murdered. These included Sadik and Vesel Muriqi, both of whom had been placed under a protection program by the ICTY.

The five countries – U.S., Britain, Germany, France and Italy – had access to information, resources and a long history of work with the Kosovo Liberation Army (KLA), former U.S. diplomat and UN Regional Representative in northern Kosovo Gerard Gallucci told Belgrade’s Politika newspaper in an interview. “Regardless of the claims about organ trafficking, everyone knows about the involvement of some of the top Kosovo leaders in transnational crime and corruption. International officials ignored these problems so as not to provoke the ethnic Albanians and prevent them from creating even bigger problems,” Gallucci stated, according to the newspaper.

New talks between Belgrade and Pristina are planned to start soon for resolving frozen Kosovo conflict. Serbs and Albanians have been in negotiations and talks half a dozen times over the past two decades – from the tentative efforts of the 1990s to the doomed talks in Rambouillet, France, in 1999 and the later “status” talks between 2005 (Ahtisaari’s pseudo-talks) and 2007 (“Troika” led talks). None of these has led to tangible results and left outsiders imposing an outcome, be it NATO intervention or proposing the Ahtisaari plan.

Few month ago it looked like now it would be possible to have real talks first time between local relevant authorities; the events on December have put this optimism in question. The PACE report gives new (for western powers, mainstream media and public) view to justification of the Nato’s attack on Serbia, it products evidence and argumentation for suspected joint venture of organized crime and political elite in Kosovo before “humanitarian intervention, after that and now: the report casts a shadow to western political leadership as their own intelligence services had all relevant information at their disposal.

In my earlier article Will Negotiation Slot for Kosovo be used? I remarked, that

EU in my opinion should start to distance itself from U.S. cowboy policy. Now many Europeans realize they were hoodwinked into recognizing Kosovo’s independence on the pretence it would resolve problems and bring peace – it didn’t happen; a new approach is needed.”

I would like to point out that now after PACE report the West can not any more escape reality, facts can not be ignored any longer. The report could be start for reassessment of Kosovo status and operations/presence of international community there.

We Bombed The Wrong Side” (General Lewis Mackenzie)


In my previous articles I have portrayed Kosovo with quite dark colours. I have summarized Kosovo

as Serbian province, occupied and now international protectorate administrated by UN Kosovo mission; as quasi-independent pseudo-state has good change to become next “failed” or “captured” state; today’s Kosovo is already safe-heaven for war criminals, drug traffickers, international money laundry and radical Wahhabists – unfortunately all are also allies of western powers”.

This description can naturally be seen as individual biased view without any connection to reality. However the process which began before Xmas may lead similar outcome in western mainstream media too. Investigations conducted by the Swiss diplomat, Dick Marty on behalf of the Parliamentary Assembly of the Council of Europe (PACE) have revealed the true picture of Kosovo’s prime minister Hashim Thaci. In his report to the PACE’s Commission, Thaci is presented as the leader of a criminal gang engaged in the smuggling of weapons, the distribution of illegal drugs throughout Europe and the selling of human organs for unlawful transplantation. The Swiss senator conducted a two-year inquiry into organised crime in Kosovo after the Council of Europe mandated him to investigate claims of organ harvesting by the Kosovo Liberation Army (KLA) after the war with Serbia ended in 1999.

Western intelligence agencies warned that Hashim Thaci ran an organised crime network in the late 1990s, they knew the KLA were criminals running the drug, slave, and weapons rackets throughout Europe, they knew the KLA was supported by Osama bin Laden (with whom Thaci met personally in Tirana in 1998 to plan the jihad in Kosovo. Despite this Western political leaders backed his Kosovo Liberation Army and its members were transformed as “freedom fighters”.

The case related to organ trafficking is now in Pristina court, according Swiss sources PM Thaçi has been prohibited from entering Switzerland “for a certain period of time”, investigations are called for allegations that sums originating from organ trafficking in Kosovo and Albania had been deposited in Swiss bank accounts. Swiss Foreign Minister Micheline Calmy-Rey has reportedly decided not to receive an award given by the Kosovo Embassy and members of the Kosovo diaspora, for her contribution to the recognition of Kosovo’s independence. In April 2008 Madam Carla Del Ponte, the former Chief Prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY), published a book La caccia – Io e i criminali di guerra. In the book, almost ten years after the end of the war in Kosovo, there appeared revelations of trafficking in human organs taken from Serb prisoners, reportedly carried out by leading commanders of the Kosovo Liberation Army (KLA). Now the report, Inhuman treatment of people and illicit trafficking in human organs in Kosovo” , for Council of Europe Parliamentary Assembly (PACE), prepared by Swiss prosecutor-turned-politician Dick Marty, expands on allegations made by Mrs. Del Ponte.

The PACE report claims that civilians – Serbian and non-KLA-supporting Kosovan Albanians detained by the KLA in the 1999 hostilities – were shot in northern Albania and their kidneys extracted and sold on the black market. It names Hashim Thaçi, the former leader of the KLA and Kosovo’s prime minister, as the boss of a “mafia-like” group engaged in criminal activity – including heroin trading – since before the 1999 war.

A Council of Europe report into organ trafficking in Kosovo linked the Medicus case to a wider criminal network in the Kosovo Liberation Army (KLA), which began trading in organs in 1999. A faction within the rebel guerilla army loyal to Thaci has been accused of overseeing a racket involving Serb captives. A “handful” were said, in the report, to have been shot in the head, then had their kidneys extracted. It is believed the kidneys were flown to Istanbul in ischemia bags. Thaci has strongly denied the claims. I also touched on a matter in my article New Cannibalism in Europe too? a couple of years ago.

In November 2008 police raided the property of Medicus clinic in a deprived suburb near the Kosovan capital Pristina. Patients from Canada, Germany, Poland and Israel had received organ transplants at the clinic. Victims were promised up to $20,000, while recipients were required to pay between €80,000 and €100,000 euros. But despite promises of payment the donors had left empty-handed; up to 30 victims lost their kidneys in the clinic in just eight months in 2008. The key player of is Dr. Yusuf Ercin Sonmez from Medicus clinic has been a key player in the unscrupulous organ market for more than 10 years.

A Washington-based intelligence source said the kidneys were sold to Dr. Sonmez, a 53-year-old medic. It was then that the Turkish doctor was said to have struck up a relationship with Kosovan Albanians, who, investigators believe, are implicated in the Medicus clinic case which unfolded in the confirmation hearing case on December in Pristina district court. However the present case is limited to Medicus clinic and its links to a wider network of Albanian organised criminals and events a decade ago will hopefully take place in wider trial. EU’s EULEX-operation in Kosovo will from its side examine allegations that the country’s prime minister is the head of a “mafia-like” criminal network linked to organ trafficking. if there is sufficient evidence against Thaçi or the other senior government figures implicated in the report, they could face prosecution even though most crimes are alleged to have taken place in Albanian territory. Whitewashing Organized Crime

War crimes related to organ scandal are only minor by-plot in context of organized crime in Kosovo during last decade. KLA’s transformation from OC-/terrorist group to freedom fighters was an amazing media victory which guaranteed the occupation and later capturing of Kosovo.

Neil Clark in his column Kosovo and the myth of liberal intervention – in the Guardian describes very well this hoax:

It was the KLA’s campaign of violence against Yugoslav state officials, Serbian and Kosovan civilians in 1998, which led to an escalation of the conflict with the government in Belgrade, with atrocities committed on both sides. The report is a damning indictment not only of the KLA but also of western policy. And it also gives lie to the fiction that Nato’s war with Yugoslavia was, in Tony Blair’s words, “a battle between good and evil; between civilisation and barbarity; between democracy and dictatorship”.

On 1999 the Western media was full of stories of mass graves and brutal rapes. U.S. officials claimed that from 100,000 up to 500,000 Albanians had been massacred. In 78 days the Pentagon dropped 35,000 cluster bombs, used thousands of rounds of radioactive depleted-uranium rounds, along with bunker busters and cruise missiles. Expecting to find bodies everywhere, forensic teams from 17 NATO countries organized by the Hague Tribunal on War Crimes searched occupied Kosovo all summer of 1999 but found a total of only 2,108 bodies, of all nationalities. Some had been killed by NATO bombing and some in the war between the UCK and the Serbian police and military.

Number game as cause of Nato’s attack on Serbia 

According the Kosovo “Book of the Dead”, the equivalent of the Bosnia “Book of the Dead” by London based Bosnian Institute which finally counted the slain, has since the Kosovo war been able to establish a total about 10,000 dead or “permanently missing” (i.e. dead), of which just under 5000 are Albanians, and the rest Serbian, other minorities, or ethnicity not known. So as Albanians made up around 50% off the dead despite making up 85% of the population, they suffered proportionately much less in terms of deaths than any other group.

I would draw following time axis about some core events with this campaign:

  • As side result U.S. created Bondsteel, one of the biggest U.S. military base in center of Europe – completely outside European/international jurisdiction – to serve also as secret torture/detention/investigation center of CIA.

In the bottom line – so far at least temporary – U.S. State Department and their British lapdogs were responsible for orchestrating or facilitating events mentioned above. For background information I recommend a video “General Lewis Mackenzie: We Bombed The Wrong Side”, anyway the headline of video is not so far from my point of view.

Thaçi and other members of his inner circle, Marty avers, were “commonly identified, and cited in secret intelligence reports,” published by the German secret state agency, the Bundesnachrichtendienst or BND “as the most dangerous of the KLA’s ‘criminal bosses’.” Trading on American protection to consolidate political power, thus maintaining control over key narcotics smuggling corridors, the special rapporteur writes that “having succeeded in eliminating, or intimidating into silence, the majority of the potential and actual witnesses against them (both enemies and erstwhile allies), using violence, threats, blackmail, and protection rackets,” Thaçi’s Drenica Group have “exploit[ed] their position in order to accrue personal wealth totally out of proportion with their declared activities.” Indeed, multiple reports prepared by the U.S. DEA, FBI, the BND, Italy’s SISMI, Britain’s MI6 and the Greek EYP intelligence service have stated that Drenica Group members “are consistently named as ‘key players’ in intelligence reports on Kosovo’s mafia-like structures of organised crime.”

Reliable and highly informed sources at the Institute for European Policy based in Germany, in a 2007 report commissioned for the German Armed Forces, indicated that the three leading Kosovo politicians, Ramush Haradinaj, Hashim Thaci and Xhavit Haliti, are “persons protected by the international community although they are deeply involved in all of these affairs.”Already in 2000, according to Interpol Kosovo criminals, illicit profits of 2 billion euros were laundered through more than 200 banks. The current data show much higher earnings, and this without considering the investments in the building sector, the purchase of shares and other activities. In relation to the drugs issue, according to the Italian journalist Roberto Saviano, in an interview in 2009, the Albanian mafia in Kosovo chiefs “dream” about turning the province into “a European Colombia.”

In order to achieve this, they wish to genetically engineer a type of coca plant that would grow in Kosovo’s climate. In this way, the Albanian mafia would have a monopoly over the cocaine trade. They need 20 years to achieve this,” he said, and added that “then, Kosovo will without a doubt become the new Colombia.”

International community unwilling to rock of the boat

“Two years ago a joke was being circulated on the Runet that a heroin producer has recognized its distributor’s independence. It was about Afghanistan, which was to the first to recognize the independence of the Serbian province of Kosovo which had illegally separated from Yugoslavia.” (GRTV)

International community has worked over ten years with capacity building of Kosovo administration; EU launched few years ago its huge EULEX operation for rule and law in protectorate. Still it was needed outside institutions to bring both individual case – organ trafficking/war crime – and a system error – OC/political link – to public knowledge. Why so?

An other report gives one answer. Reliable and highly informed sources at the Institute for European Policy based in Germany, in a 2007 report commissioned for the German Armed Forces, indicated that the three leading Kosovo politicians, Ramush Haradinaj, Hashim Thaci and Xhavit Haliti, are “persons protected by the international community although they are deeply involved in all of these affairs.”Already in 2000, according to Interpol Kosovo criminals, illicit profits of 2 billion euros were laundered through more than 200 banks. The current data show much higher earnings, and this without considering the investments in the building sector, the purchase of shares and other activities. In relation to the drugs issue, according to the Italian journalist Roberto Saviano, in an interview in 2009, the Albanian mafia in Kosovo chiefs “dream” about turning the province into “a European Colombia.”

In order to achieve this, they wish to genetically engineer a type of coca plant that would grow in Kosovo’s climate. In this way, the Albanian mafia would have a monopoly over the cocaine trade. They need 20 years to achieve this,” he said, and added that “then, Kosovo will without a doubt become the new Colombia.”

International community unwilling to rock of the boat

“Two years ago a joke was being circulated on the Runet that a heroin producer has recognized its distributor’s independence. It was about Afghanistan, which was to the first to recognize the independence of the Serbian province of Kosovo which had illegally separated from Yugoslavia.” (GRTV)

International community has worked over ten years with capacity building of Kosovo administration; EU launched few years ago its huge EULEX operation for rule and law in protectorate. Still it was needed outside institutions to bring both individual case – organ trafficking/war crime – and a system error – OC/political link – to public knowledge. Why so?

An other report gives one answer. Extract from recent the Council of Europe Parliamentary Assembly (PACE) Rapporteur Jean-Charles Gardetto’s report entitled The protection of witnesses as a cornerstone for justice and reconciliation in the Balkans (The document should be adopted by the Council of Europe Parliamentary Assembly (PACE) on coming January 26.)

Moreover, when a witness does come forward, there is a real threat of retaliation. This may not necessarily put them in direct danger, losing their job for example, but there are also examples of key witnesses being murdered. The trial of Ramush Haradinaj, the former leader of the Kosovo Liberation Army, well illustrates this. Mr. Haradinaj was indicted by the ICTY for crimes committed during the war in Kosovo but was subsequently acquitted. In its judgment, the Tribunal highlighted the difficulties that it had had in obtaining evidence from the 100 prosecution witnesses. Thirty-four of them were granted protection measures and 18 had to be issued with summonses. A number of witnesses who were going to give evidence at the trial were murdered. These included Sadik and Vesel Muriqi, both of whom had been placed under a protection program by the ICTY.

The five countries – U.S., Britain, Germany, France and Italy – had access to information, resources and a long history of work with the Kosovo Liberation Army (KLA), former U.S. diplomat and UN Regional Representative in northern Kosovo Gerard Gallucci told Belgrade’s Politika newspaper in an interview. “Regardless of the claims about organ trafficking, everyone knows about the involvement of some of the top Kosovo leaders in transnational crime and corruption. International officials ignored these problems so as not to provoke the ethnic Albanians and prevent them from creating even bigger problems,” Gallucci stated, according to the newspaper.

Conclusion/Possible reflections?

New talks between Belgrade and Pristina are planned to start soon for resolving frozen Kosovo conflict. Serbs and Albanians have been in negotiations and talks half a dozen times over the past two decades – from the tentative efforts of the 1990s to the doomed talks in Rambouillet, France, in 1999 and the later “status” talks between 2005 (Ahtisaari’s pseudo-talks) and 2007 (“Troika” led talks). None of these has led to tangible results and left outsiders imposing an outcome, be it NATO intervention or proposing the Ahtisaari plan.

Few month ago it looked like now it would be possible to have real talks first time between local relevant authorities; the events on December have put this optimism in question. The PACE report gives new (for western powers, mainstream media and public) view to justification of the Nato’s attack on Serbia, it products evidence and argumentation for suspected joint venture of organized crime and political elite in Kosovo before “humanitarian intervention, after that and now: the report casts a shadow to western political leadership as their own intelligence services had all relevant information at their disposal.

In my earlier article Will Negotiation Slot for Kosovo be used? I remarked, that

EU in my opinion should start to distance itself from U.S. cowboy policy. Now many Europeans realize they were hoodwinked into recognizing Kosovo’s independence on the pretence it would resolve problems and bring peace – it didn’t happen; a new approach is needed.”

I would like to point out that now after PACE report the West can not any more escape reality, facts can not be ignored any longer. The report could be start for reassessment of Kosovo status and operations/presence of international community there.

We Bombed The Wrong Side” (General Lewis Mackenzie)


In my previous articles I have portrayed Kosovo with quite dark colours. I have summarized Kosovo

as Serbian province, occupied and now international protectorate administrated by UN Kosovo mission; as quasi-independent pseudo-state has good change to become next “failed” or “captured” state; today’s Kosovo is already safe-heaven for war criminals, drug traffickers, international money laundry and radical Wahhabists – unfortunately all are also allies of western powers”.

This description can naturally be seen as individual biased view without any connection to reality. However the process which began before Xmas may lead similar outcome in western mainstream media too. Investigations conducted by the Swiss diplomat, Dick Marty on behalf of the Parliamentary Assembly of the Council of Europe (PACE) have revealed the true picture of Kosovo’s prime minister Hashim Thaci. In his report to the PACE’s Commission, Thaci is presented as the leader of a criminal gang engaged in the smuggling of weapons, the distribution of illegal drugs throughout Europe and the selling of human organs for unlawful transplantation. The Swiss senator conducted a two-year inquiry into organised crime in Kosovo after the Council of Europe mandated him to investigate claims of organ harvesting by the Kosovo Liberation Army (KLA) after the war with Serbia ended in 1999.

Western intelligence agencies warned that Hashim Thaci ran an organised crime network in the late 1990s, they knew the KLA were criminals running the drug, slave, and weapons rackets throughout Europe, they knew the KLA was supported by Osama bin Laden (with whom Thaci met personally in Tirana in 1998 to plan the jihad in Kosovo. Despite this Western political leaders backed his Kosovo Liberation Army and its members were transformed as “freedom fighters”.

The case related to organ trafficking is now in Pristina court, according Swiss sources PM Thaçi has been prohibited from entering Switzerland “for a certain period of time”, investigations are called for allegations that sums originating from organ trafficking in Kosovo and Albania had been deposited in Swiss bank accounts. Swiss Foreign Minister Micheline Calmy-Rey has reportedly decided not to receive an award given by the Kosovo Embassy and members of the Kosovo diaspora, for her contribution to the recognition of Kosovo’s independence. Organ trafficking case

In April 2008 Madam Carla Del Ponte, the former Chief Prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY), published a book La caccia – Io e i criminali di guerra. In the book, almost ten years after the end of the war in Kosovo, there appeared revelations of trafficking in human organs taken from Serb prisoners, reportedly carried out by leading commanders of the Kosovo Liberation Army (KLA). Now the report, Inhuman treatment of people and illicit trafficking in human organs in Kosovo” , for Council of Europe Parliamentary Assembly (PACE), prepared by Swiss prosecutor-turned-politician Dick Marty, expands on allegations made by Mrs. Del Ponte.

The PACE report claims that civilians – Serbian and non-KLA-supporting Kosovan Albanians detained by the KLA in the 1999 hostilities – were shot in northern Albania and their kidneys extracted and sold on the black market. It names Hashim Thaçi, the former leader of the KLA and Kosovo’s prime minister, as the boss of a “mafia-like” group engaged in criminal activity – including heroin trading – since before the 1999 war.

A Council of Europe report into organ trafficking in Kosovo linked the Medicus case to a wider criminal network in the Kosovo Liberation Army (KLA), which began trading in organs in 1999. A faction within the rebel guerilla army loyal to Thaci has been accused of overseeing a racket involving Serb captives. A “handful” were said, in the report, to have been shot in the head, then had their kidneys extracted. It is believed the kidneys were flown to Istanbul in ischemia bags. Thaci has strongly denied the claims. I also touched on a matter in my article New Cannibalism in Europe too? a couple of years ago.

In November 2008 police raided the property of Medicus clinic in a deprived suburb near the Kosovan capital Pristina. Patients from Canada, Germany, Poland and Israel had received organ transplants at the clinic. Victims were promised up to $20,000, while recipients were required to pay between €80,000 and €100,000 euros. But despite promises of payment the donors had left empty-handed; up to 30 victims lost their kidneys in the clinic in just eight months in 2008. The key player of is Dr. Yusuf Ercin Sonmez from Medicus clinic has been a key player in the unscrupulous organ market for more than 10 years.

A Washington-based intelligence source said the kidneys were sold to Dr. Sonmez, a 53-year-old medic. It was then that the Turkish doctor was said to have struck up a relationship with Kosovan Albanians, who, investigators believe, are implicated in the Medicus clinic case which unfolded in the confirmation hearing case on December in Pristina district court. However the present case is limited to Medicus clinic and its links to a wider network of Albanian organised criminals and events a decade ago will hopefully take place in wider trial. EU’s EULEX-operation in Kosovo will from its side examine allegations that the country’s prime minister is the head of a “mafia-like” criminal network linked to organ trafficking. if there is sufficient evidence against Thaçi or the other senior government figures implicated in the report, they could face prosecution even though most crimes are alleged to have taken place in Albanian territory. Whitewashing Organized Crime

War crimes related to organ scandal are only minor by-plot in context of organized crime in Kosovo during last decade. KLA’s transformation from OC-/terrorist group to freedom fighters was an amazing media victory which guaranteed the occupation and later capturing of Kosovo.

Neil Clark in his column Kosovo and the myth of liberal intervention – in the Guardian describes very well this hoax:

It was the KLA’s campaign of violence against Yugoslav state officials, Serbian and Kosovan civilians in 1998, which led to an escalation of the conflict with the government in Belgrade, with atrocities committed on both sides. The report is a damning indictment not only of the KLA but also of western policy. And it also gives lie to the fiction that Nato’s war with Yugoslavia was, in Tony Blair’s words, “a battle between good and evil; between civilisation and barbarity; between democracy and dictatorship”.

On 1999 the Western media was full of stories of mass graves and brutal rapes. U.S. officials claimed that from 100,000 up to 500,000 Albanians had been massacred. In 78 days the Pentagon dropped 35,000 cluster bombs, used thousands of rounds of radioactive depleted-uranium rounds, along with bunker busters and cruise missiles. Expecting to find bodies everywhere, forensic teams from 17 NATO countries organized by the Hague Tribunal on War Crimes searched occupied Kosovo all summer of 1999 but found a total of only 2,108 bodies, of all nationalities. Some had been killed by NATO bombing and some in the war between the UCK and the Serbian police and military.

Number game as cause of Nato’s attack on Serbia 

According the Kosovo “Book of the Dead”, the equivalent of the Bosnia “Book of the Dead” by London based Bosnian Institute which finally counted the slain, has since the Kosovo war been able to establish a total about 10,000 dead or “permanently missing” (i.e. dead), of which just under 5000 are Albanians, and the rest Serbian, other minorities, or ethnicity not known. So as Albanians made up around 50% off the dead despite making up 85% of the population, they suffered proportionately much less in terms of deaths than any other group.

I would draw following time axis about some core events with this campaign:

  • As side result U.S. created Bondsteel, one of the biggest U.S. military base in center of Europe – completely outside European/international jurisdiction – to serve also as secret torture/detention/investigation center of CIA.

In the bottom line – so far at least temporary – U.S. State Department and their British lapdogs were responsible for orchestrating or facilitating events mentioned above. War Crime Hypocrisy

Related to Serbia’s EU association process nearly every progress report of European Commission highlights Serbia’s cooperation with Criminal Tribunal for the former Yugoslavia (ICTY). Although the country has demonstrated its commitment to moving closer to the EU by building up a track record in implementing the provisions of the Interim Agreement with the EU and by undertaking key reforms the fact that so far as indictees Ratko Mladić and Goran Hadžić are still at large it is hard to demonstrate full cooperation with ICTY. As ICTY cooperation is a key priority of the European Partnership this makes a formal cause to halt association process (and if fugitives will be deported to Hague then the next obstacle will be recognition of Kosovo).


While EU speaks about standards or criteria during association talks so should some already members look occasionally mirror. Few news about older war crimes from last months popped to my eyes and raise a doubt in my mind about double-standards. Suspected hypocrisy does not limit to EU only but to U.S. and Nato as well. EU seems be unwilling to put their war crimes from recent history on the same line than other smaller players ones.

Following some older and newer cases for consideration.

USA/Serbia
Serbia has requested the extradition of an American citizen accused of committing genocide and other crimes as a Nazi officer during World War II. Mr. Peter Egner, 86 lives now in a retirement community outside of Seattle, Washington. Egner, a Yugoslavia native, is accused of joining in April 1941 the Nazi-controlled Security Police and Security Service in German-occupied Belgrade, a Nazi mobile killing unit that participated in the mass murder of more than 17,000 Serbian civilians during World War II. Egner came to the United States in 1960 and became a citizen six years later.

Egner has admitted volunteering to serve in the Security Police and Security Service as well as guarding prisoners as they were being transferred to concentration camps. He also admitted to serving as an interpreter during interrogations of political prisoners, which sometimes involved severe torture. Prisoners often were executed following their interrogations. Serbia’s war crimes prosecutor has said that he wants to try Egner in Serbia. (Source: Jpost )

Germany/Holland

The Simon Wiesenthal Center called on Germany to extradite Dutch former SS executioner Klaas Faber, in a statement released on Thursday. Center’s third Most-Wanted Nazi War Criminal, Klaas Faber, 88, received life sentence in Holland, before escaping to Germany in 1952. The Netherlands released recently an arrest warrant for Faber, 88. In September, Germany’s Justice Ministry said it is looking into the possibility of jailing Faber more than 60 years after his conviction. The Dutch government requested that Faber be extradited several times, so that he could serve his sentence, which had been commuted to life in prison.

Dr. Efraim Zuroff, the Wiesenthal Center’s chief Nazi-hunter said: “Germany’s failure hereto to put Faber on trial or return him to Holland are a travesty which must be corrected as quickly as possible, while justice can still be achieved.” (Source: Jpost/Wiesenthal Center calls for SS executioner’s extradition )

Still Hilfe, or Silent Aid, an organization which provides help for Third Reich fugitives of justice, is funding the defense of Klass Faber. Stille Hilfe is known for helping Nazi fugitives Klaus Barbie and Erich Priebke evade justice as well as facilitating the escape of Adolf Eichmann and Josef Mengele to South America. The German Social Democratic party has called for a probe into the organization’s charitable status, but thus far, Berlin has taken no action against Stille Hilfe. Germany

A court in Germany says the world’s third most-wanted Nazi suspect has died before he could be brought to trial. Bonn’s state court said in a statement Monday that 89- year-old Samuel Kunz died November 18. Kunz was indicted on charges he was involved in the entire process of killing Jews at the Belzec death camp: from taking victims from trains to pushing them into gas chambers to throwing corpses into mass graves. The Simon Wiesenthal Center issued a statement in response to the news. where Efraim Zuroff, the center’s director in Israel, said it was “incredibly frustrating” that Kunz died before trial. “The fact that Samuel Kunz lived in Germany unprosecuted for so many decades is the result of a flawed prosecution policy which ignored virtually any Holocaust perpetrator who was not an officer. It was only the recent, long-awaited change in this policy which led to Kunz’s indictment and the opportunity to hold him accountable for his crimes. (Source JPost )

Vatican?

As time goes its harder to get old WWII fugitives to trial. However while individual persons are dying some executive organizations related to war crimes still are healthy – one of these is Vatican.

I have in my mind especially Vatican’s role in holocaust and preserving war criminals from justice. These issues are dealt in my earlier article “Jasenovac – Holocaust promoted by Vatican” but the crucial questions were following:

During WWII Croatia’s Ustashe leaders declared that they would slaughter a third of the Serb population in Croatia, deport a third and convert the remaining third from Orthodoxy to Roman Catholicism. 3rdbiggest extermination center – behind Auschwitz and Treblinka – created by Nazis was Jasenovac in Croatia. The death toll is estimated to be 300,000 to 700,000, some 80 % of them Serbs the rest Jews and Romas. While for Nazi-Germany Jasenovac was more a tool for ethnic cleansing for Ustashe religious aspect played crucial role. The religious motivation may be the explanation to the extreme brutality of butchers in Jasenovac. 743 Roman Catholic priests personally murdered Serbs, Jews and Gypsies. Jasenovacwas for a time, run by Fr. Filipovic-Majstorovic, a Catholic priest. The Jasenovac system of Croatian camps also included a camp for children run by Catholic nuns who used toxic soda to save bullets.

As the war ended, the Vatican Bank helped to and transfer funds Franciscans in Rome helped smuggle and launder the Ustasha Tresury, which was looted from victims of Jasenovac. The Vatican not only hoarded the gold the Croats looted, it also helped Ustasha war criminals in escaping justicein what is now nicknamed the “Vatican Ratline”.

Today a class action law suit against the Vatican Bank to recover $100 million in damages for the Vatican’s participation in these war crimes and money laundering the proceeds from their Serb, Jewish and Roma victims is still ongoing. Vatican lawyers have three times tried to get this case thrown out of court. The Supreme court has rejected their claims. In US District Court the case against the Vatican Bank (but not the Franciscan Order) was dismissed on grounds the Vatican Bank is an organ of a sovereign entity, the Vatican, which is immune from lawsuits. The just filed appeal however argues that the Vatican Bank is not sovereign and engages in commercial activity in the United States and therefore should be held accountable in a United States Federal Court.

U.S & Nato

Besides Vatican also Nato and U.S. has continuously escaped from justice or international court about its war crimes in Balkan wars – especially in case of Nato’s attack on Serbia 1999 – as well its activities in Iraq, Afghanistan and other clandestine operations around the world. Bombing civilian targets, using cluster and DU (depleted uranium) bombs can be seen as war crimes or at least violations of international law and the Geneva Conventions in particular. Nato planes destroyed 4 % of its military targets during bombing – partly because for avoiding own casualties they launched missiles so high that could not make difference between wooden decoys and real weapons. Instead of military targets the main damage was made against civilian targets such as destroying an embassy (China), a prison (Istok), three column of Albanian refugees (81 dead March 13th and 75 April 14th), radio-tv station (Belgrade, 16 civilians dead), a passenger train (Grdelica bridge, 14 dead), also a number of infrastructure, commercial buildings, schools, health institutions, cultural monuments were damaged or destroyed. Some 2.500 people (mostly civilians) were dead, material civil infrastructure damage is estimated to be some 30 billion dollars.

Serbia has tried to put Nato already to International Court for war crimes during bombing 1999. And of course without success since big or important enough players don’t give a s…t about Hague and like U.S have already sealed an impunity with bilateral agreements in mission regions. Bottom line

If EU would like to act in line with its high-flown ideals it should stand straight-backed behind international court principles so that no country could be immune its rulings. And if some countries like U.S. look themselves to be above international law appropriate measures – such as sanctions – should be taken against it. And this probably is total utopia. Despite this one should not forget old war crimes especially when neo-Nazism and xenophobia gains ground even among today’s EU (e.g. Hungary) members as well candidate (e.g. Croatia) countries.

I don’t put very much weight to ICTY rulings but however from my point of view the procedure itself brings more facts about events on the table, especially when both the prosecutor and defence have made their case. At best this can make easier to bring justice also to lower level.

“Less than one percent of priests are guilty of this…” ( Ratzinger)

When visit of pope Benedict is coming closer in UK a wide debate has started about possibility to put pope in court due protecting paedophile priests. George Monbiot wrote in the Guardian how the case against pope rests on international law’s potential to judge all alike. A quote:

Over the weekend, the authors Richard Dawkins and Christopher Hitchens announced that they’ve asked lawyers to prepare a case against the pope. Recently, in the Guardian, Geoffrey Robertson, the barrister they are consulting, explained that senior churchmen who protected paedophile priests, swore their victims to secrecy and allowed the perpetrators to continue working with children, committed the offence of aiding and abetting sex with minors. Practised on a large scale, this becomes a crime against humanity recognised by the international criminal court. This is the general Vatican policy over which the then Cardinal Ratzinger is accused of presiding. When Benedict comes to the UK in September he could, if Dawkins and Hitchens get their warrant, be arrested.

From my viewpoint not only the Pope but Vatican as state and some its institutions should put on trial for crimes against humanity. And not only due the spreading paedophile scandal but WWII crimes too. With later I have in my mind especially Vatican’s role in holocaust and preserving war criminals from justice. These issues are dealt in my earlier article “Jasenovac – Holocaust promoted by Vatican” but the crucial questions were following:

In principle I think that these kind of issues should be handled in international court like International Court of Justice (ICJ) or The International Criminal Court (ICC) both in Hague or in some maybe new International Criminal Tribunal (like ICTY for Yugoslavia and Ruanda). The second option could be trial in national courts like now ongoing against Vatican in US and now planned in UK. Third possibility could be solving case outside courtroom with money and compensations but I prefer more formal procedure or at least that Vatican would really confess its guild for events during WWII and after that.



Jasenovac – Holocaust promoted by Vatican

The UN General Assembly chose January 27 as the official day for the commemoration, as it was on this day in 1945 that Soviet troops liberated the Auschwitz extermination camp, the last such camp still functioning. Throughout Europe, tributes will be paid to the 53 million people who died during World War II, of whom 31 million were civilians. Commemoration has linked usually also to International Holocaust Remembrance Day.

Auschwitz-Birkenau was the largest extermination center created by the Nazis. It has become the symbol of the Holocaust and of wilful radical evil in our time. Few people know that 3rd biggest extermination center was Jasenovac. Two reasons maybe explain this: 1st it is located in Croatia and 2nd the main part of victims were Serbs. The death tolls in extermination centres vary but rough estimations are following (source Wikipedia):

  • Auschwitz II 1,400,000

  • Belzeg 600,000
  • Chelmno 320,000
  • Jasenovac 600,000
  • Majdanek 360,000
  • Maly Trostinets 65,000
  • Sobibor 250,000
  • Treblinka 870,000


Background

Upon the occupation of Yugoslavia, the German Nazis and the Italian Fascists formed an “independent” state in Croatia, which was basically a Nazi puppet state. Immediately upon the establishment of its puppet government, the Ustashe set up militias and gangs that slaughtered Serbs, Jews, Romas and their political foes. Catholic priests, some of them Franciscans, also participated in the acts of slaughter. The cruelty of the Ustashe was so great that even the commander of the German army in Yugoslavia complained. The partisans, led by the Croat Communist Josip Broz Tito, and the Chetniks – Nationalist Serb royalists – fought the Ustashe.


Under the leadership of the Ustasha leader Ante Pavelic’s right-hand man Andrija Artukovic, who earned the nickname “the Himmler of the Balkans,” the Ustashe set up concentration camps, most notably at Jasenovac. According to various estimates, about 100,000 people were murdered at the camp, among them tens of thousands of Jews (it is interesting to note that some of the heads of the Ustashe were married to Jewish women). Throughout Croatia about 700,000 people were murdered.

Jasenovac

Located in Croatia 62 miles south of Zagreb, Jasenovac was Croatia’s largest concentration and extermination camp. Jasenovac, was a network of several sub-camps, established in August 1941 and dissolved in April 1945. Jasenovac was not the only place where Serbia’s neighbour Croatia ran several concentration camps where Jews, Serbs and Roma have been murdered. Bosnian Muslims and Kosovo Albanians were allies of Hitler as well. (More about Jasenevac in my document library under headline Croatia )

In April 1945 the partisan army approached the camp. In an attempt to erase traces of the atrocities, the Ustaša blew up all the installations, killed most of the internees and tried to hide all evidence about brutalities in Jasenovac, all material evidence disappeared as if there had not been any camp in that place. Later – during Tito’s time – the state and the authorities tried to implement “Brotherhood and Unity” motto, with the aim of creating tolerance between the nations and the crime had to be forgotten as soon as possible.

Encyclopedia of the Holocaust, edited by Yisrael Gutman, vol. 1, 1995, pp. 739-740 gives following description about problems to find exact numbers:

It is difficult to establish the number of victims killed in the Jasenovac concentration camp, since many documents were destroyed. The prisoners’ files were destroyed twice (at the beginning of 1943 and in April, 1945) and even if they had been preserved, they would have been of little help discerning the truth, because the Ustasha often killed the newly arrived prisoners immediately, without putting their names into the files. This is particularly true of those who arrived from Slavonia, Srem and Kozara, because it was only noted down that 9,830, or 155 wagons had arrived. For instance, a very small number of Gypsies was filed, only a few hundred, while it is known that all 25,000-35,000 of them from the NDH were killed in Jasenovac. The Jewish community in Yugoslavia has established the number of 20,000 Jews that were killed in Jasenovac. The numbers of killed Serbs are truly varied. The sources from abroad mention numbers from 300,000 to 700,000. Be that as it may, most of the people killed in Jasenovac were Serbs. Exact number being still unknown, but it surely amounts to several hundreds of thousands. The National Committee of Croatia for the investigation of the crimes of the occupation forces and their collaborators stated in its report of November 15, 1945 that 500,000-600,000 people were killed at Jasenovac. ”

The Yad Vashem center claims that over 500,000 Serbs were killed in the NDH (now Croatia), including those who were killed at Jasenovac, where approximately 600,000 victims of all ethnicities were killed.

Religious aspect

While for Nazi-Germany Jasenovac was more a tool for ethnic cleansing for Ustashe religious aspect played crucial role. The aim and its implementation efficiency is described differently by people who actually were in Balkans during that period. Ustashe leaders declared they would slaughter a third of the Serb population in Croatia, deport a third and convert the remaining third from Orthodoxy to Roman Catholicism. Anyone who refused to convert was murdered.


One may claim that the religious motivation and the brutality of butchers were leading principles in Jasenovac. The fact that 743 Roman Catholic priests were members of the Ustashi and personally murdered Serbs, Jews and Gypsies. Jasenovac was for a time, run by Fr. Filipovic-Majstorovic, a Catholic priest who admitted to killing “40,000 Serbs with his own hands.” So at one point, a Franciscan monk was camp commandant of what the second largest concentration camp of the war.

The Jasenovac system of Croatian camps also included a camp for children run by Catholic nuns who used toxic soda to save bullets.

Roman Catholic priests who participated in the killing of tens of thousands of Serbs, Jews and Gypsies and the running of Jasenovac escaped Europe through the “Vatican Ratline” run by Fr. Draganovich, a Croatian Catholic priest who helped morons like Clause Barbe escape from Europe. Those Catholic priests escaped to Argentina where they also escaped justice.


Vatican connection


In 1999 a class action law suit was filed at a court in San Franciso against the Vatican Bank (Institute for Religious Works) and against the Franciscan order, the Croatian Liberation Movement (the Ustashe), the National Bank of Switzerland and others to recover $100 million in damages for the Vatican’s participation in these war crimes and money laundering the proceeds from their Serb, Jewish and Roma victims. The suit was filed by Jewish, Ukrainian, Serb and Roma survivors, as well as relatives of victims and various organizations that together represent 300,000 World War II victims. The plaintiffs demanded accounting and restitution.

Franciscans in Rome helped smuggle the Ustasha Tresury and assisted Ustasha war criminals in escaping justice. The Vatican Bank is alleged to have laundered a portion of the Ustasha Treasury. The Vatican not only hoarded the gold the Croats looted, it also helped them escape – with a nod and wink from the OSS and MI6. In 1986 for example, the US government released documents that revealed the Vatican had organised the Ustasha leader Ante Pavelic’s safe-flight from Europe to Argentina, along with 200 senior officials of his regime. Pavelic was given refuge by the Vatican, fascist Spain, and Peronist Argentine. The Ustasha Minister of the Interior, Artukovic, lived openly in California from 1949-1986 when he was finally deported to Yugoslavia and convicted of murder. Thousands of Ustasha escaped justice for their crimes due to their wealth and influence and the backing of the Roman Catholic Church and who along with certain rogue elements in the US and UK governments portrayed these war criminals as anticommunist freedom fighters.

As the war ended, it is now known that the Vatican Bank and other world banks helped to launder and transfer funds out of the Reich, and helped many war criminals to escape justice in what is now nicknamed the “Vatican Ratline”


The Vatican Bank has claimed ignorance of any participation in Ustasha crimes or the disappearance of the Croatian Treasury. Memory today

On Summer 2008 Israels ambassador to Croatia, Shmuel Meirom, harshly criticized the funeral given to a head of a WWII Jasenovac concentration camp in Zagreb, saying also that it insulted the memory of those killed in the camp run by Croatia’s Nazi-allied Ustasha regime.“I’m convinced that the majority of the Croatian people are shocked by the way the funeral of the Jasenovac commander and murderer, dressed in an Ustasha uniform, was conducted,” ambassador Meirom said in a written statement. “At the same time, I strongly condemn the inappropriate words of the priest who served at the funeral and said that Sakic was a model for all Croats” Meirom said. Yearly commemoration is important remainder for fair picture of history. At least one day per year is good to think what ultra nationalism can be at its worst level, what kind of interests, power game, attitudes and hidden motivations are creating possibilities for murdering civil populations or ethnic groups.




Croatians voted for Change

The last election in Croatia can bring a refreshing change with new President Ivo Josipovic – a university law professor and a composer of classical music – but he will find a much tougher struggle ahead of him. This struggle not only due economical problems (national debt and unemployment) but also problems related to Croatia’s past. These problems are highlighted when Croatia is on final round to come next EU member state.

President elected Mr Josipovic took already new direction towards Croatia’s neighbour Serbia. Croatia and Serbia have filled genocide lawsuits against each other in international court about events during the war of the 1990s. Mr Josipovic told that he is ready to find common solution by direct negotiations with Serbs without trial. “I will negotiate with Belgrade about the missing persons, war crimes trials and the return of cultural treasures. If they accept these conditions there is no reason to proceed with the genocide suit,“ said new Croatian president. (More in my articleCroatia’s and Serbia’s ‘Genocide’ Case to Proceed”)


Historical burdens

However, in Croatia’s accession process, one trial still is left related to the International Criminal Tribunal for the former Yugoslavia (ICTY). ICTY wants access to important documents on the use of artillery by Croatian forces during the Balkan war in the 1990s. These are needed in relation with the trial of general Ante Gotovina, indicted by ICTY for war crimes while expelling Krajna Serbs from Croatia in 1995 under the “Operation Storm”. This ethnic cleansing caused innocent victims, and caused around 200,000 Serbs to flee the former Yugoslav republic at the end of the 1991-1995 war. Between 1991 and 1995, 220,000 ethnic Croats and subsequently up to 300,000 ethnic Serbs were displaced by armed conflict in Croatia. Since then almost all the Croat IDPs have returned to their homes, while most of the Serbs displaced have resettled in Serbia or in the majority-Serb Danube region of Croatia. Since the end of the conflict, only one third of Croatian Serb IDPs and refugees have been able to return. (More e.g. in article “Forgotten refugees – West-Balkans”)


Croatia & EU-membership

The fact Greece exists in the EU means that we do not have to do anything else in terms of judicial reform, and the fact that certain Baltic states are members means that we have nothing to do in the realm of minority policies. (President of the Croatian Helsinki Committee Žarko Puhovski)

Croatia is suffering due the massive political corruption. During early years of independency Croatia has been transforming itself into a mafia state; ruling Croatian Democratic Union (HDZ) have presided over a creeping authoritarian kleptocracy, bribery, kickbacks and cronyism are ubiquitous. Last European Commission progress report of Croatia highlighted the need need to pursue its reform efforts, in particular on the judiciary and public administration, the fight against and organised crime, and minority rights. Government has been also cracking down on the independent media. The regime controls state television and radio, suppressing dissent – especially, any investigations into high-level HDZ corruption – and also recently some journalists have been killed and physically assaulted.


Ironically the Croatian population is not any more so interested about EU, according Gallups mentioned earlier among the Western Balkan countries, Croatia shows the lowest percentage of people convinced that EU accession would be good for their country (29%) the largest group of people in the country (38%) felt that EU membership would neither be good nor bad. The amount of EU Scepticism in Croatia is big despite or because Croatians feel most sufficiently informed about EU in Western Balkans. (Source: “Gallup Balkan Monitor-Focus on EU Perceptions”)


Only 39% thought that a majority supports EU accession, while 45% thought that most Croats are opposed to entering the EU. Opinions about this issue are unevenly distributed: support for the EU is higher among the urban population (35%) and people with a university education (51%).


Differences can also be observed between the different regions of Croatia: support for the EU is highest in the urban region around Zagreb (Zagrebacka Regija, 36%), while rather rural areas such as Istocna Regija and Središnja Hrvatska have rather low support with, respectively, 21% and 22%.


Nationalism

One concern related to Croatia’s joining to the EU could be Croats’ strong identification with their own country: 65% of interviewees (Gallup mentioned earlier) identified very or extremely strongly with Croatia; this was one of the highest percentages in the region. This might indicate that, 17 years after independence, residents in Croatia are still more interested in establishing their national identity than in looking towards Europe.

One very alarming trend is (over)emphasizing Croatia’s Nazi past. During WWII Croatia was created and supported by Nazi Germany and Fascist Italy. It thus adopted their racial and political doctrines as well practices. Jasenovac was Croatia’s largest concentration and extermination camp. From total 600,000 murdered ones some 25,000 were Gypsies, some 25,000 Jews and over half a million Serbs. From time to time some symptoms of this past are occurring also today ad even with support of government (More e.g. in my article “Nazi’s funeral shadows Croatians past )


One aspect influencing Croatian patriotic feelings is the situation of Croats in neighbouring Bosnia-Herzegovina. Some time ago a Croatian NGO Libertas made public statement in which it says that Croatians in Bosnia are victims of Bosnian Muslim terror and are asking Bosnian Croat political leadership to initiate a plan that will break up the Bosnian Federation entity and form a Croatian one. Do possible three entities (each of them with Bosniak, Croat or Serb majority) of have any reason to hang together in same state or are more alluring prospects other side of the borders?


Bottom line


I believe that Croatia’s road to EU came with elections easier than before e.g. because

  • Josipovic declared that the struggle for justice and against corruption would be his absolute priority;
  • As clean person Josipovic has good credibility with his anti-corruption struggle unlike his opponent had;
  • With landslide victory the voters made a clear choice so appreciating the values and program of new president;
  • New president has already showed his readiness to ease (ethnic) tensions with neighboring Serbia and the same will probably happen also with Bosnia-Herzegovina (his opponent hinted support to create and possible separate Croat dominated region from BiH); the border dispute with Slovenia is already solved;
  • Economical cooperation with Serbia will probably develop e.g. when Croatia is taking more active role with implementation of South Stream gas pipeline project.

The country is expected to complete its accession negotiations in 2010 and join in 2012. With new president this is very realistic.
